Terms of Service

Welcome to Listahanan.ph. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the Platform.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Listahanan.ph ("we," "us," or "our") governing your access to and use of the website listahanan.ph and all related services (the "Platform").

By using the Platform, you confirm that:

  • You are at least eighteen (18) years old;
  • You have the legal capacity to enter into a contract under Philippine law;
  • You agree to be bound by these Terms and our Privacy Policy.

2. Platform Nature & Transaction Risk

Listahanan.ph is an online real estate listing and lead generation platform that connects property buyers with licensed brokers and property owners.

We provide tools for:

  • Searching and browsing property listings;
  • Posting listings (brokers and owners);
  • Facilitating inquiries and lead connections.

We do not:

  • Act as a real estate broker or salesperson;
  • Negotiate or finalize transactions;
  • Represent any party in a transaction;
  • Process payments or provide escrow services.

All transactions are conducted solely between users, who assume full responsibility for due diligence. Compliance with Republic Act No. 9646 is the responsibility of the users.

3. Accounts and Listings

3.1 Broker Accounts

By registering a broker account, you represent that:

  • Your PRC license is valid and active;
  • You are compliant with DHSUD requirements;
  • You hold a valid Authority to Sell for each listing.

3.2 Owner Accounts

By registering an owner account, you represent that:

  • You are the lawful owner or authorized representative;
  • Documents submitted are authentic.

3.3 Account Security

You are responsible for safeguarding your account credentials and must immediately notify us at contactus@listahanan.ph of any unauthorized use.

3.4 Listing Standards

All listings must be:

  • Accurate and not misleading;
  • Supported by authentic photos;
  • Updated or removed when unavailable;
  • Authorized by proper ownership or authority.

We may remove listings at our discretion.

4. Verification & User Responsibilities

  • Verification badges (“Verified Broker” / “Verified Owner”) reflect a good-faith review at a specific point in time and do not guarantee ongoing license validity, title clearance, or absence of fraud.
  • Users must conduct independent due diligence.

You agree not to:

  • Post fraudulent listings;
  • Engage in unlicensed brokerage (“colorum”) in violation of RA 9646;
  • Submit false or forged documents;
  • Violate any Philippine law, including RA 9160 (Anti-Money Laundering Act).
We reserve the right to investigate suspected violations, suspend accounts, and report to the appropriate authorities.

5. Lead Generation & Broker Interaction

  • By submitting an inquiry, you consent to your contact information being shared with the relevant broker to respond to your request.
  • Only necessary information is shared (name, email, phone, and property details).
  • Brokers are responsible for handling your data in compliance with RA 10173.
  • We are not responsible for the broker's conduct or any transaction.
  • Users may opt-out of lead sharing at any time by contacting dataprotection@listahanan.ph.

6. Payments and Fees

  • All financial transactions occur directly between users at their own risk.
  • We may introduce fees in the future with prior notice.
  • Paid fees are non-refundable unless otherwise stated.

7. Intellectual Property

  • All Platform content is owned by Listahanan.ph.
  • By submitting content, you grant a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute content for operating, promoting, and improving the Platform.
  • You represent that you have the rights to grant this license.

8. Analytics and Tracking

  • We use Google Analytics and similar tools to understand user behavior and improve the Platform.
  • Data collected may include device information, usage patterns, IP addresses, and referring URLs.
  • Cookies are used to track preferences and interactions.
  • Data collected is primarily aggregated and anonymized.
  • Users can opt-out via browser settings or the Google Analytics Opt-out Browser Add-on.

9. Disclaimers & Limitation of Liability

  • The Platform is provided “AS IS” without warranties of any kind.
  • We do not guarantee uninterrupted access or accuracy of listings.
  • Users acknowledge they do not rely on the Platform, content, or verification badges as a substitute for professional advice.

Limitation of Liability

  • Indirect, incidental, consequential, special, or punitive damages are excluded.
  • Total aggregate liability shall not exceed the amount paid in the three (3) months immediately preceding the claim, or PHP 1,000, whichever is higher.
  • Liability is not limited for fraud, willful misconduct, gross negligence, or obligations that cannot be lawfully excluded.
  • Lead generation or broker interactions are included in the limitation above; we are not liable for broker misconduct.

10. Indemnification

You agree to indemnify, defend, and hold harmless Listahanan.ph and its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Platform or violation of these Terms.

11. Service Modifications

We may modify, suspend, or discontinue any part of the Platform at any time, with or without notice, and without liability to you.

12. Dispute Resolution

Users agree to attempt amicable resolution before initiating legal claims. You may contact us at contactus@listahanan.ph to initiate this process.

13. Governing Law & Venue

These Terms are governed by the laws of the Republic of the Philippines. All disputes shall be filed exclusively in the courts of Quezon City, Philippines.

14. Termination and Legal Provisions

  • We may suspend or terminate accounts for violations or activities that harm the Platform.
  • Sections regarding privacy, liability, and indemnification survive termination.
  • If any provision is held invalid or unenforceable, remaining provisions remain in full force.

15. Contact

By continuing to use Listahanan.ph, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Effective date: March 24, 2026. These Terms supersede all prior agreements between you and Listahanan.ph regarding use of the Platform. See also our Privacy Policy and Trust & Safety page.
